WecareWehelp Inc (“WecareWehelp”, “we”, “us”) respect and are committed to protecting the privacy of users of our websites, applications, and other online and electronic services (collectively, the “Online services”). We have created this privacy policy (“Privacy Policy”) in order to set out how we collect, use, and disclose personal information through our website located at www.wecarewehelp.com (the “platform”) as well as to personal information we collect and use when we provide technological services to help the registered medical practitioners (“medical practitioners”, “doctors”, “hospitals”) on our platform. This Privacy Policy applies to all of the services (as more particularly described in our Terms of Use).

The privacy of our users is of great importance to us and we take pride in making sure that your personal and health data is used solely for providing you the best medical services through our website services. By visiting our Website and/or using the Services in any manner, you acknowledge that you have read the terms of use and practices and policies outlined in this Privacy Policy and you understand that your Personal Information will be collected, used and disclosed in accordance with this Privacy Policy.

 

2. What is covered in this Privacy Policy

 

Personal Information may be collected about our prospective customers, visitors to the Website, and end users of the Services. You can choose not to provide us with certain Personal Information, but by doing so, you may not be able to take advantage of many of the features and functionality of our Services.

This Privacy Policy describes our collection, use and disclosure of information about identifiable individuals, including information which can be used to identify an individual (“Personal Information”). Personal Information does not include any anonymized information which we may create or derive from information (including Personal Information) you provide to us.

We may also collect Personal Information about patients of our Medical Practitioners on behalf of the Medical Practitioners. This Privacy Policy does not apply to the practices of companies that we do not own or control, including Medical Practitioners. Our Medical Practitioners are responsible for maintaining their own privacy policies governing the collection, use and disclosure of Personal Information and for ensuring that they have obtained the necessary authorizations and consents for any Personal Information made available to us for use in accordance with this Privacy Policy. If you have any questions regarding the privacy practices of a particular Medical Practitioner, please contact the Medical Practitioner directly.

 

3. What personal data we collect and why we collect it

 
We collect Personal Information you choose to submit to us through the platform, such as your name, email address and other Account Information. When users leave comments on the site, we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. When you access or use the platform, we may automatically receive and record information on our server logs from your browser, including your IP address, cookies, and the pages you request. IP addresses are automatically reported by your browser each time you view a web page. Your IP address is stored by WecareWehelp when you register with WecareWehelp. We also collect and use personal information as a service provider or data processor on behalf of our Medical Practitioners clients, including billing information, that we collect directly from our Medical Practitioners.
 
We collect and use personal data for the following purposes:
  • In order to provide platform services to our Medical Practitioners
    • In order to provide the services to our Medical Practitioners, we collect certain Personal Information such as contact and registration information from the medical practitioner. For Medical Practitioners who register to appear on our platform, we will collect Personal Information related to the medical practice, including business contact name, email, phone number, address, as well names of practitioners, services they offer and their specialties.
    • We collect this Personal Information to match Medical Practitioners with prospective patients.
    • Some of the Personal Information received by WecareWehelp in connection with the Services may be provided by Medical Practitioners who are health care providers that are subject to health information data protection laws and regulations.
    • In the United States, this includes rules issued under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and Health Information Technology for Economic and Clinical Health Act of 2009 (HITECH), that govern the use and disclosure of certain individually identifiable health-related Personal Information (“Protected Health Information”) by covered entities and their business associates. When we receive Protected Health Information, we may do so as a “Business Consultant” of the health care provider under an agreement that, among other things, generally prohibits us from using or disclosing the Protected Health Information in ways that are not permissible by the health care provider itself, and requires us to implement certain measures to safeguard the confidentiality, integrity, and availability of the Protected Health Information. When we act as a Business Consultant, we may be subject to certain laws and regulations, including certain HIPAA rules, that govern our use and disclosure of Protected Health Information and that may be more restrictive than otherwise provided in this Privacy Policy.
    • In Canada, WecareWehelp is a service provider and may act as a service provider, information manager or electronic service provider under applicable privacy legislation, including Ontario’s Personal Health Information Protection Act (PHIPA) regulations.
  • In order to create your user accounts for doctors, patients, potential users and hospital administrators
    • In order to use certain platform services (such as to book an appointment), users may be required to create a valid WecareWehelp user accounts.
    • When you register on the platform, WecareWehelp collects your name, email address, birth date, zip or postal code, and if you are a Medical Practitioners, your business phone number and business address (“Account Information”). Generally, WecareWehelp uses the Account Information to authenticate access to the Account and provide access to the services.
    • We will use your email address to contact you with medical practitioners located near you.
    • We may also use this information to better understand, improve and personalize the delivery of the platform services, to conduct our business, to develop analytics and aggregated data that allow us to improve our services to correspond with you including to send technical notices, updates, security alerts and support and administrative messages on our own behalf or on behalf of Medical Practitioners.
    • We also use information to investigate and prevent fraudulent transactions, unauthorized access to the platform, and other illegal activities.
    • If you book an appointment with a Medical Practitioner through our platform, WecareWehelp will have access to information about your use of the services such as health appointments made, geo-location data and information exchanged between you and the Medical Practitioners that is combined with your Account Information. We use this information in order to provide services, such as suggesting and matching users with local medical practitioners and appointment scheduling, as well as to confirm appointments have been completed so that we may bill our Medical Practitioners.
  • In order to contact prospective doctors, patients, potential users and hospital administrators
    • We collect names, email addresses and other contact information about individuals who we consider to be prospective users. We use third-party service providers to identify prospective users and locate contact information to contact prospective users about our services.
  • In order to enable payments for users and medical practitioners, we leverage the WooCommerce platform in coordination with Stripe and Interac to ensure secure payment gateways for various payments made through the platform
    • WooCommerce tracks the following data and information in order to help us provide better services through our platform:
      • Location, IP address and browser type: we use this for purposes like estimating taxes
      • We also use cookies to keep track of contents while you’re browsing our platform.
      • When users complete a booking or doctors purchase packages, we’ll ask you to provide information including your name, billing address, email address, phone number, credit card/payment details and optional account information like username and password. We ask for this information to send users information about your account and booking details, respond to your requests, including refunds and complaints, process payments and prevent fraud, comply with any legal obligations we have, such as calculating taxes and send you marketing messages, if you choose to receive them.
    • Stripe Payments gateway enables secured credit card payments and deposits through our checkout page for users of the platform. Stripe being a highly reputed and prestigious payments gateway handles the security and legal obligations pertaining to the transactional data as per laws and as detailed in their global privacy policy at https://stripe.com/gb/privacy.
  • In order to distribute marketing communications
    • With your consent, we use your email address or mobile phone number as well as other information on an optional basis to help us tailor our communications to you. You will receive email or text message communications from us regarding our services and initiatives.
    • If you do not wish to receive these communications, you can unsubscribe from such promotional e-mails at any time by clicking on the unsubscribe link in any of our e-mail communications or you can reply STOP to any of our text messages. Alternatively, you can opt-out of receiving marketing communications by contacting us at the contact information provided in the “Contact Us” section below.
    • Please note that you may continue to receive transactional or account-related communications from us, such as technical notices, security alerts and support and administrative messages.
  • In order to request for feedback and referrals
    • If you have a User Account, we may use your contact information to request feedback and referrals for our services. If you post a feedback review about WecareWehelp or a doctor or hospital, we collect your name and the feedback review.
    • Your name and other personal information will not be published with the feedback review; however your feedback review will be publicly available on the platform.
    • Please exercise caution before sharing any personal information, and review our Terms of Use for more about posting feedback reviews.
  • In order to improve our platform services to help our users better
    • We utilize demographic information collected about our users for our own business purposes, including forecasting demand for our services or a particular medical practice, improving our services and creating a personalized experience through targeted initiatives.
    • Personal Information is not shared with any third parties for these purposes.
  • In order to assist users when they reach out to us for help though our platform or third party communication services
    • When users contact us with a comment, question or complaint through email, telephone, or message features available on the platform or through third parties, they may be asked for information that identifies them, such as their name, address and a telephone number, along with additional information we need to help us promptly answer the question or respond to the comment.
    • We may retain this information to assist you in the future and to improve our customer service offerings.
 
 

4. What Personal Data is collected when you make comments

When users or platform visitors leave comments on the platform, we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. The data is collected and analysis is conducted to improve the experience for the doctors, patients, users and hospital administrators on our platform.

An anonymized string created from your email address (also called a hash) may be provided to the third party services to see if you are using it. After approval of your comment, your profile picture is visible to the public in the context of your comment.

 

5. What is our policy in reference to Minors surfing our platform

 

WecareWehelp does not knowingly solicit or collect data from children nor knowingly market to anyone under the age of majority in their jurisdiction of residence. If you are under the age of 13, you are explicitly not authorized to use our platform and the services offered on the platform. If you become aware that your child has provided us with Personal Information without your consent, please contact us at support@WecareWehelp.com. If we become aware that a child under the age of majority in their jurisdiction of residence has provided us with Personal Information, we will take reasonable steps to remove such information from our systems and terminate the applicable account.

 

6. What is our policy in terms of the uploaded or shared Media on our platform

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Users on the platform can download and extract any location data from images on the website.

The media uploaded by patients, doctors, potential users or hospital administrators is solely available on the platform to facilitate platform services and help the platform users receive the best experience on the platform.

 

7. Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year. We use cookies to recognize devices and provide a personalized experience on our platform, and to authenticate your device in order to provide you access to your User Account and facilitate your use of our services. We use session cookies containing encrypted information to allow the system to uniquely identify you while you are logged in. This information allows us to process your online transactions and requests. Session cookies help us make sure you are who you say you are after you’ve logged in and are required in order to use the platform services. If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

If you prefer, you can turn off cookies in your web browser by changing your browser’s security settings. Please note, however, some features of our Products and Services may not function properly if your browser’s cookies are disabled. You may be able to set your browser to notify you when you are sent a cookie. This gives you the choice to decide whether or not to accept it.

 

8. Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

 

9. Analytics

We may use a third party such as Google Analytics to help us gather and analyze information about the areas visited on the platform (such as the pages most read, time spent, search terms and other engagement data) in order to evaluate and improve the user experience and the Website. These third parties may use cookies and other tracking technologies. 10. How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our platform, we also store the personal information they provide in their user account profile. All platform users can see, edit, or delete their personal information at any time (except they cannot change their username). Platform administrators can also see and edit that information  (except they cannot change their username).

We also store information identifying users who have accessed data that we store about patients, and any changes they make to such data. We use this information to comply with legal obligations relating to such data and to keep a record of such changes. We may also use it to improve our platform services, where such use is permitted by law.

 

11. What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

You have the right to access and update any errors in the Personal Information which is present on our platform. If you make a written request through our platform contact services, we will provide you with access to or a copy of your Personal Information, although in certain limited circumstances where permitted under law, we may not be able to make all relevant personal information available to you, such as where that information also pertains to another user. In such circumstances we will provide reasons for the denial to you.

 

12. Where we send your data or who do we share the data with

We highly value the trust our users put in our platform while engaging with the platform services.

We may use a third party such as Google Analytics or Hotjar to help us gather and analyze information about the areas visited on the platform we analyze the data to render better services on the platform. Platform users and visitors comments may be checked through an automated spam detection service.

 

13. How we protect your data

 

Our platform is on a highly secure SSL certified domain – SSL stands for Secure Sockets Layer, a global standard security technology that enables encrypted communication between a web browser and a web server . SSL certificates are a small data files that cryptographically establish an encrypted link between a web server and a browser. It encrypts the data that’s being transmitted.

We do not sell, rent or lease personal data. We, and service providers may disclose your Personal Information to third parties without your consent in response to a warrant or other legally valid inquiry or order, for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process. Your personal information may also be disclosed where necessary for the establishment, exercise or defense of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.
